Please read these terms carefully before placing your order. By completing a purchase during the Legacy Sale, you acknowledge that you have read, understood, and agreed to the return terms set out below.

1. Sale Period

The Legacy Sale runs from September 3 at 5AM PT to September 7 at midnight PT.

Early access opens to our SMS VIP list from September 2, 2pm PT. When the sale begins; an access password will be sent by text message only. Anyone can sign up to be a part of the early access promotion. Message and data rates may apply. Reply STOP to unsubscribe.

This offer is available only during the period stated above and will not be extended unless otherwise announced by OddBird Co.

2. Discount Details
30% off is applied sitewide. All prices displayed are the discounted prices ("as marked").
No additional discount codes, promotions, or offers may be combined with this sale.
Any "compare at" or crossed-out price shown reflects OddBird Co.'s own regular selling price for that item during the ninety (90) days preceding this sale.
Sales tax and shipping charges, where applicable, are calculated on the discounted merchandise price.
Price adjustments will not be made on orders placed before the sale begins or after it ends.
Discounts apply to in-stock merchandise only and exclude gift cards, made-to-order pieces, preorder items and shipping charges.

3. Returns - Legacy Sale Items
⚠️ EXCHANGES AND STORE CREDIT ONLY — NO REFUNDS

ALL LEGACY SALE PURCHASES ARE FINAL AS TO PAYMENT. NO CASH, CREDIT CARD, DEBIT CARD, OR OTHER MONETARY REFUNDS WILL BE ISSUED FOR ANY LEGACY SALE ITEM. ELIGIBLE RETURNS WILL BE RESOLVED BY SIZE OR COLOR EXCHANGE, OR BY ISSUANCE OF STORE CREDIT, AT THE CUSTOMER'S CHOICE.

To be eligible for an exchange or store credit:

Timing: You must initiate a return request through our returns portal within [14] days of delivery, and the item must be postmarked back to us within [14] days of your return authorization being issued.

Condition: Items must be unworn, unwashed, unaltered, free of odor, marks, and pet hair, and returned in original condition with all tags and original packaging attached.

Value.: Store credit is issued for the amount you actually paid for the returned merchandise, including any sales tax collected on that item. Original shipping charges, expedited shipping upgrades, and return protection fees are not included.

Return shipping: Return shipping is the customer's responsibility unless covered by return protection purchased at checkout.

Exchanges are subject to inventory availability. If your requested exchange item is unavailable, store credit will be issued instead.

Items that arrive outside the condition or timing requirements above may be returned to you at your expense, or refused.

This section does not apply to items designated Final Sale (see Section 4) or to damaged, defective, incorrect, or undelivered orders (see Section 5).

4. Final Sale Items
⚠️ FINAL SALE — NO RETURNS, NO EXCHANGES, NO STORE CREDIT

ITEMS DESIGNATED "FINAL SALE" ARE SOLD AS A FINAL TRANSACTION. THEY CANNOT BE RETURNED, EXCHANGED, OR CREDITED FOR ANY REASON OTHER THAN THOSE DESCRIBED IN SECTION 5 BELOW.

Final Sale items are discounted more deeply than the sitewide 30% and are clearly marked "FINAL SALE" on the product page.
Because these pieces cannot be returned or exchanged, please review the garment measurements, size chart, fabric composition, and product description carefully, and contact our team with any fit questions before ordering.
At checkout, you will be asked to affirmatively acknowledge that your order contains Final Sale merchandise.
Final Sale designation is confirmed on your order confirmation and packing slip.

5. Damaged, Defective, Incorrect, or Undelivered Orders

This section applies to every order placed during the Legacy Sale, including Final Sale items.

Nothing in these Terms limits your rights under applicable law with respect to merchandise that is damaged, defective, materially not as described, or not the item you ordered.

If your order arrives damaged, defective, or is not the item you ordered, contact customerservice@oddbirdco.com within seven (7) days of delivery with your order number and photographs of the item and packaging.
Where a claim is verified, we will provide a replacement of the same item where available; if a replacement is not available, we will provide store credit or a refund to your original payment method, at your election.
If your order is not delivered, contact us and we will investigate with the carrier and make you whole.

Nothing in these Terms waives, limits, or disclaims any warranty right that cannot lawfully be waived, including the implied warranty of merchantability under the California Song-Beverly Consumer Warranty Act (Cal. Civ. Code § 1790 et seq.), or any other right you may have under applicable federal or state consumer protection law.

6. Shipping & Processing Times
Free standard shipping on orders over $250 USD (calculated before tax, shipping, and return protection).
Due to expected order volume, please allow up to 3-4 weeks for order processing before shipment. Our small team processes each order by hand, and we deeply appreciate your patience.
Shipping and handling charges are not refundable or creditable.
Risk of loss passes to you upon delivery by the carrier.

Shipment delays: If we are unable to ship your order within the processing time stated above , we will notify you and offer you the choice of consenting to the delay or cancelling your order for a full refund to your original payment method. This right applies notwithstanding the no-refund terms in Sections 3 and 4.

7. Order Cancellations & Changes

Once an order is placed, we are unable to guarantee changes or cancellations. If you contact us at customerservice@oddbirdco.com before your order enters fulfillment, we will make reasonable efforts to assist you. Once an order has entered fulfillment or shipped, it is governed by Sections 3 through 5.

8. Store Credit Terms
Store credit is issued electronically to the email address associated with your order, typically within 3–5 business days of our receipt and inspection of your return.
Store credit does not expire.
Store credit is redeemable toward merchandise on oddbirdco.com and may be applied to shipping and tax at checkout.
Store credit is not redeemable for cash, except where required by law. California residents holding a store credit with a remaining balance of less than ten dollars ($10) may request the balance in cash.
Store credit is non-transferable, carries no interest, and has no cash value except as stated above.
If a store credit is used toward a subsequent purchase and that purchase is returned, any resulting credit will be reissued as store credit.

9. Gift With Purchase

Orders totalling $300 USD or more (calculated before tax, shipping, and return protection) will receive a complimentary OddBird Gift, valued at $49, while supplies last. Eligible orders will automatically include the gift.

If you return items from your order and your remaining order total falls below the $300 threshold, the gift must be returned with your merchandise. If you choose to keep the gift, its $49 value will be deducted from the store credit or exchange value you receive.

10. Customer Care

Our team is here to help, though response times may be slightly delayed during the sale. Please allow up to three (3) business days for a reply at customerservice@oddbirdco.com.

11. Notice to California Residents

In accordance with California Civil Code § 1723, OddBird Co. provides the following notice of its return policy for Legacy Sale merchandise:

NO CASH REFUNDS. LEGACY SALE MERCHANDISE MAY BE EXCHANGED OR RETURNED FOR STORE CREDIT ONLY, WITHIN 14 DAYS OF DELIVERY, IN ORIGINAL UNWORN CONDITION WITH TAGS ATTACHED. ITEMS MARKED "FINAL SALE" MAY NOT BE RETURNED OR EXCHANGED. THIS POLICY DOES NOT APPLY TO MERCHANDISE THAT IS DAMAGED, DEFECTIVE, OR NOT AS ORDERED.

12. General Terms
Acceptance. Placing an order during the Legacy Sale constitutes acceptance of these Terms.
Changes. OddBird Co. may modify these Terms prospectively at any time. The Terms in effect at the time of your order govern that order.
Errors. We reserve the right to correct pricing or descriptive errors and to cancel and refund any order placed at an incorrect price.
Governing law. These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
No waiver of statutory rights. Nothing in these Terms is intended to waive or limit any right you may have under applicable federal or state law that cannot be waived by agreement.
